DPP fails to get Khama to speak

Count 3, among the corruption charges put to former Debswana celebrity executive, Louis Nchindo, might fly out the window should the Directorate of Public Prosecutions fail to obtain a statement from President Ian Khama.
By 2 o’clock yesterday, the DPP was still struggling to get a statement from Khama, vice president under Festus Mogae’s tenure as president. They failed.
The DPP had orders from Gaborone Village chief magistrate, Lot Moroka, that at that hour they should have collected all the statements requested of Mogae’s cabinet, relating to the case- if they intend to use the statements during the case.
Magistrate Moroka had ordered that the statements should have been passed on to the defence by March 26.

FRAUD requires a harm,an economic loss.
Even if Ian Khama sends a statement to DPP and
acnowledges that Nchindo lied to him,this still would NOT have ANY legal consequences.
The lie does not constitutes EVEN an atempt to commit fraud as as far as I know the facts ,
the ACTUS REUS is missing.
Therefore NO criminal delict on count four.
So…if Khama gives or DOES NOT give any statement
is without any relavance.

FRAUD is an intentional deception resulting in INJURY to another.
It must be at least “a proximate injury” to the deceited person.
When Nchindo was lieing to Khama about the existance of a
department at Debswana company,which promotes tourism in Botswana,he may provided
a FALSE misrepresentation…
regrettably the delict of FRAUD requires material misrepresentation.
Did Nchinto conseal a material fact?
Did he have the INTENT through his action to constitute a
HARM;an INJURY(economic loss ,loss of his reputation,diminishing his standing in the society ) to Ian Khama?
No!
Even if Khama writes a statemnt,that Nchindo lied on date so and so to him and told him farytales about a NONEXISTING department at Debswana,
IT WAS A “WHITE” LIE!
